रायपुर। केंद्र की मोदी सरकार द्वारा वन संरक्षण कानून के नियमों में बदलाव का विरोध करते हुए छत्तीसगढ़ किसान सभा ने इन बदलावों को कॉरपोरेटों के हाथों वन संसाधनों को सौंपने और आदिवासियों के अस्तित्व को खत्म करने की साजिश करार दिया है। किसान सभा का कहना है कि संशोधित नियमों ने ग्राम सभाओं और वनों में रहने वाले आदिवासी समुदायों और अन्य पारंपरिक वनवासियों के अधिकारों को पूरी तरह से समाप्त कर दिया है, क्योंकि सरकार द्वारा विकास परियोजनाओं के अनुमोदन और मंजूरी से पूर्व प्रत्येक ग्राम सभा की सहमति की अनिवार्यता को खत्म कर दिया गया है। इसलिए इन नियमों को तुरंत निरस्त किया जाना चाहिए।
आज यहां जारी एक बयान में छत्तीसगढ़ किसान सभा के अध्यक्ष संजय पराते और महासचिव ऋषि गुप्ता ने कहा है कि वन संरक्षण कानून के नियमों में इस प्रकार के संशोधनों से निजी और कॉरपोरेट कंपनियों का देश के वनों पर नियंत्रण स्थापित होगा। संशोधित नियमों के अनुसार प्रतिपूरक वनीकरण के लिए अन्य राज्यों की गैर-वन भूमि उपलब्ध कराई जाएगी, जिसका सीधा प्रभाव आर्थिक और सामाजिक रूप से कमजोर तबकों के भूमि-विस्थापन के रूप में सामने आएगा और जिनके लिए पुनर्वास और मुआवजे का कोई प्रावधान नहीं किया गया है। इस प्रकार भूमिहीनों की जमीन भी कॉरपोरेट कंपनियों के हाथों चली जायेगी।
किसान सभा नेताओं ने कहा है कि वन कानून के नियमों में ये संशोधन पूरी तरह से आदिवासी समुदायों और कमजोर तबकों को दी गई संवैधानिक गारंटी के खिलाफ है तथा यह आदिवासी वनाधिकार कानून, पांचवीं और छठी अनुसूचियों, पेसा और संशोधित वन्य जीवन संरक्षण अधिनियम का भी उल्लंघन है। ये संशोधित नियम वर्ष 2013 में नियमगिरि खनन मामले में सुप्रीम कोर्ट के फैसले का भी उल्लंघन है।
किसान सभा ने आरोप लगाया है कि इन नियमों को प्रभावित समुदायों से विचार-विमर्श किये बिना और जनजातीय मामलों के मंत्रालय के सुझावों को नजरअंदाज करके बनाया गया है। इसलिए इन नियमों को संसद की संबंधित स्थायी समिति के पास जांच के लिए भेजा जाना चाहिए, देश की आम जनता के साथ सलाह-मशविरा किया जाना चाहिए और जनजातीय मामलों के मंत्रालय की राय को शामिल किया जाना चाहिए, जो वन अधिकार अधिनियम के क्रियान्वयन के लिए नोडल मंत्रालय है। तब तक के लिए इन नियमों को लागू करना स्थगित करने की मांग किसान सभा ने की है।

Opposing the changes in the rules of the Forest Conservation Act by the Modi government at the Center, the Chhattisgarh Kisan Sabha has termed these changes as a conspiracy to hand over forest resources to the corporates and trying to end the existence of tribals. The Kisan Sabha says that the amended rules have completely abolished the rights of gram sabhas and forest-dwelling tribal communities and other traditional forest dwellers. Until now the approval of development projects by the government requires the consent of each gram sabha, this requirement has been done away with the amended rules. Therefore these rules should be repealed immediately.
In a statement issued here today, Chhattisgarh Kisan Sabha President Sanjay Parate and General Secretary Rishi Gupta said that such amendments in the rules of the Forest Conservation Act will establish control over the forests of the country by private and corporate companies. According to the amended rules, non-forest land of other states will be made available for compensatory afforestation, the direct impact of which will be in the form of land-displacement of tribals and economically and socially weaker sections and for whom no provision for rehabilitation and compensation has been made. In this way the land of the landless will also go into the hands of corporate companies.
Kisan Sabha leaders have said that the amendments in the rules of the Forest Act is completely against the constitutional guarantee given to the tribal communities and weaker sections and it is also against the Tribal Forest Rights Act, Fifth and Sixth Schedules, PESA and the amended Wildlife Protection Act. These amended rules are also in violation of the Supreme Court’s decision in the Niyamgiri mining case in the year 2013.
The Kisan Sabha has alleged that these rules have been made without consulting the affected communities and ignoring the suggestions of the Ministry of Tribal Affairs. Therefore, these rules should be sent to the relevant Standing Committee of Parliament for examination, consultation with the general public of the country and the opinion of the Ministry of Tribal Affairs, which is the nodal agency for the implementation of Forest Rights Act, should be taken. CG Kisan Sabha has demanded to postpone the implementation of these rules.
